After your employer is notified, seek medical attention. See if you can finish your shift early and go see a doctor. Your company may already have a routine in place for emergency situations.

Some companies have a medical department for this reason. If your doctor states you’re not fit to work, they will provide documentation proving your condition.

File Your Claim

File your claim — only if your employer doesn’t first. If your doctor believes you will be out of work for more than a week, your employer must file Form WC-100 with the Workers Compensation Agency.

If your employer has insurance, then the insurance company will conduct an investigation.

You’ll have to fill out form WC-117. This is an employee’s claim report and can be found on the Workers Comp website. After receiving the form, the agency will notify your employer. You have up to two years to file but you should file ASAP.

After your claim is filed (and you win your suit, if applicable) you can start collecting workers comp. The payments are provided by the employer or their insurance company.

You start collecting this money on the eighth day of your absence. If you’ll be out of work for longer than two weeks, you’ll also be compensated for the first seven days of your absence.
